Your criminal case is just one side of your driving while intoxicated (DWI) arrest. The other side is the suspension of your driver’s license. This is a civil case based on your refusal or failure of a breath/blood test administered to determine your blood alcohol concentration (BAC) after a DWI arrest. Once arrested, you have only 15 days to request an Administrative License Revocation (ALR) hearing to challenge the suspension of your license. If you fail to request a hearing in time, you lose your right to challenge the suspension.

ALR Hearings & License Suspension for Houston DWI Arrests

If you are arrested for DWI in Houston, you may face license suspension for one of two reasons:

  • Refusing a breath or blood test: If you refused to take a breath or blood test after your arrest, you may face license suspension for 180 days – for a first offense. A second offense may result in a 2-year suspension.
  • Failing a breath or blood test: If you took a breath or blood test and had a result of .08 or greater, above the legal limit to operate a motor vehicle, you may face license suspension for 90 days for a first offense, or 1 year for a second offense.

ALR hearings are overseen by Administrative Law Judges. They are conducted independently from criminal DWI cases, and you need an attorney who understands these specific civil proceedings if you are to persevere.
