Aggravated Assault DW SBI FV (1st Degree)

Justice was served today. My client accidentally killed his wife when he backed over her in their driveway. Her blood was .062 and his was .112. What started out as an Intoxicated Manslaughter (2-20) was escalated to an Aggravated Assault causing Serious Bodily Injury with a Deadly Weapon to a Family Member (5-life). Under the new case he could get deferred adjudication probation from a judge, if appropriate.
Client was 62 and they were married for 42 years. Never been arrested a day in his life. Testified that he’s just waiting to go to heaven to be with her again. Their grown children wanted the case to be dismissed. However, the rest of the family, who were very religious and anti-alcohol, wanted 10-15 years. They tried to bring up old skeletons in the closet to say it was an abusive relationship. And, argued that when he floored it in reverse angrily, he basically meant to kill her. The client accepted full responsibility for his actions and knew he drove recklessly.

We proceeded to the Judge for PSI hearing to determine punishment (deferred probation or up to life in prison). After hearing all of the evidence, Judge deferred a finding of guilt for 10 years probation and 100 days in jail. If client completes his probation successfully, the charges will be dismissed. Justice was fair and served today.
I can’t even imagine this nightmare happening in my own life and marriage: the kids begging not to lose another parent while the parents are screaming for prison. What an emotional nightmare… Blink of an eye, your whole world can change.
Thanks to the DAs for having a solidly fought hearing. And thanks to the Judge for recognizing what a tragic accident this really was and delivering a fair and just sentence.
